Oyo Court Orders Removal of Globacom Mast

Justice Muktar Abimbola of the Oyo State High Court on Wednesday ordered the removal of a Globacom mast erected at Ashipa Village, Alakia Isebo, Ibadan.

Three persons- Alhaji Ganiyu Kolawole, Alhaja Musilimat Kolawole and Mrs Morili Akintunde- had approached the court complaining about the location of the mast close to their houses.

Giving his ruling on the matter, Abimbola said the erection of the mast close to the houses of the claimants had disallowed them from peaceful enjoyment of their residence.

The judge also said that the claims of the claimants were not challenged as the respondent failed to appear inspite of being served with court processes.

He consequently ordered the removal of the mast.

The judge also restrained Globacom Limited, their agents and whosoever derives title from them from further acts of creating nuisance through the emission of dangerous smoke on the houses of the claimants.

The counsel to the claimants, Dare Adebayo, had told the court that the mast vibrates and emits gaseous materials, adding that these constitute health hazards to the claimants.

He said that the vibration often resulted in physical and emotional trauma to the claimants, adding that they found it difficult to sleep or rest.

Adebayo said the vibration of the mast had negative impact on the houses as the structures had begun to show traces of cracks that may lead to eventual collapse if immediate action was not taken.

He said his clients had been living peacefully at the site without hindrance or disturbance before the erection of the mast by Globacom Limited, pleading that it should be removed. (NAN)
